The German version of this Confidentiality Statement is the legally binding document. This English translation is provided for convenience. In the event of any discrepancy, the German version shall prevail.

1. Scope

This Confidentiality Statement applies to the use of FinOptory AI on the website of GD Green Dopamine GmbH (hereinafter "Provider"). By confirming, the user acknowledges the following terms.

2. Purpose

FinOptory AI enables an initial professional assessment of questions relating to SAP contract governance, ACV, derived charges, renewal governance and related topics. The results serve exclusively as general guidance and do not constitute legal, tax or contractual advice.

3. Confidential Information

All information transmitted by the user in the course of using the chat is considered confidential, in particular:

Contract contents, terms and prices
Internal metrics and consumption data
Company-specific configurations and system landscapes
Names, positions and contact details

4. Obligations of the Provider

The Provider undertakes to:

Treat the content transmitted in the chat as confidential
Not disclose it to third parties unless required for service delivery
Not allow any inferences about the user or their company in anonymised evaluations
Not use chat content for marketing purposes or references

5. Limitations and Notices

FinOptory AI is powered by an AI language model (Anthropic Claude). Transmitted content is transferred to the model provider for processing. The Provider has concluded a data processing agreement (DPA) with the model provider that governs purpose-limited use and confidentiality.

Despite all due care, the Provider cannot guarantee absolute confidentiality when using cloud-based AI services. For highly sensitive contract content, the Provider recommends concluding a separate non-disclosure agreement (NDA) as part of a direct consulting engagement.

6. Data Protection

The processing of personal data is carried out in accordance with the Provider's Privacy Policy and in compliance with the GDPR.

7. Duration

The Provider's confidentiality obligation extends beyond the duration of the chat session and does not end when the session is closed.

8. Separate NDA

Upon request, an individual, bilateral non-disclosure agreement (NDA) may be concluded that goes beyond the provisions of this statement. This is particularly recommended when specific contract documents or detailed financial information are to be discussed.

9. Governing Law

Austrian law applies. The place of jurisdiction is Villach, Austria.
